Why regulated industries cannot treat AI like a consumer app

For a healthcare practice, a law firm, or a financial services firm, the question is no longer whether to adopt AI. Your competitors are already using it, and your own staff almost certainly are too, often through free consumer tools that were never built for regulated data. McKinsey’s research on AI adoption has shown that the majority of organizations now use AI in at least one function, which means the realistic risk is not that your firm moves too fast. It is that AI is already in use without controls, governance, or an audit trail.

That gap is where regulatory exposure lives. When an employee pastes a patient record, a client matter, or account details into a public tool, the data may leave your control, may be retained, and may be used to train a model you do not own. The staged adoption path

Stage 1: Risk assessment and data classification

Before any tool is approved, you need to know where your regulated data lives and which workflows touch it. A practical risk assessment answers three questions for leadership:

  • What data classes are in play. Protected health information, privileged client material, financial account data, and personally identifiable information each carry different obligations. Map them.
  • Where shadow AI already exists. Survey which teams are already using consumer tools, and for what. This is usually the single largest source of current exposure.
  • What the highest-value, lowest-risk first use cases are. Drafting, summarization, and internal research often deliver fast wins without touching the most sensitive records, which makes them ideal pilots.

This stage is governance, not technology. The output is a simple classification that tells you which use cases can start immediately and which require stronger boundaries first. Stage 2: Establish hard data boundaries

Once you know what you are protecting, the next stage is to make sure regulated data cannot leak by default. Two boundaries matter most.

The first is tenant isolation. Your AI environment should be dedicated to your firm, not pooled with other organizations, and your data should never be used to train shared models. In a regulated industry, a system you cannot audit is a liability. Every AI interaction should produce a record of who used the system, what was submitted, what was returned, and when. This is the same standard you already apply to your electronic records, your case management system, or your financial platform.

Audit logging does three things for leadership. It supports your compliance obligations during a review. It gives you an investigation trail if something goes wrong. And it gives you visibility into how AI is actually being used across the firm, which is often the difference between a controlled rollout and an unmanaged one. Stage 4: Compliance mapping

The final structural stage is mapping each control you have put in place to the specific obligations of your regulatory environment. For a healthcare practice, that means aligning data handling, access, and logging to HIPAA expectations. For a financial services firm, it means addressing the data-protection and recordkeeping obligations specific to that sector. For firms handling data on California residents or EU subjects, it means accounting for CCPA and GDPR.

Each stage above implies ownership. Someone has to run the risk assessment, configure the boundaries, stand up audit logging, maintain the compliance mapping, and keep all of it current as both AI and regulation evolve.
